GENERAL TERMS & CONDITIONS - BALEARIA ----TRANSPORTATION CONTRACT----- 1. The ticket is individual and non-transferable. The vehicle's license number must be the same as the license number appearing on the ticket. Seated passengers have the right to carry up to a maximum of 20 kilos of personal luggage. 2. No responsibility is taken for articles of value that passengers carry and which they have not entrusted with the captain on boarding. Likewise, no responsibility is taken for any damage caused directly and exclusively by the failure to comply with governmental laws, regulations or orders. 3. In order for a claim to be accepted, it must be accompanied by the ticket receipt retained by the passenger, who implicitly agrees to all of the conditions therein, upon using the ticket as a travel document. Claims for damages to or loss of checked-in luggage must be filed in writing to the Company or its agent at the time the luggage is returned or at the time it was to be returned. 4. Prior to the travel date, the fare for the transport contracted though this ticket is subject to modification, without prejudice of the traveller's right to cancel the contract and be refunded the amount paid in the event that the price varies by more than 20% of the original ticket price. This ticket will not be valid if the applicable fare has not been paid. 5. Passengers may obtain from the Company a refund of the ticket in the case of not having used it in accordance with the following conditions: a) For refunds requested up to 7 days before the departure of the vessel, 10% will be deducted from the sum of the ticket. b) For refunds requested less than 48 hours before the departure of the vessel, 20% will be deducted from the sum of the ticket. c) Tickets presented for cancellation after the above-mentioned times will not be admitted. If a travel agency has issued the ticket, they must process the refund. 6. Schedules and itineraries are subject to change due to breakdowns, unforeseeable circumstances or force majeure. In such cases, the Company will adopt reasonable controlled measures to make the affected passengers aware of such changes. If necessary, the carrier may choose to be substituted by another carrier or may use other available ships. 7. Any passenger who does not board the ship for any reason beyond the Company's control shall not have the right to a refund of the ticket amount. 9. Tickets issued OPEN are valid for one year from the date of issue, and their use is subject to prior reservation of seat. 10. Passengers are subject to the regulations and rules of good order established aboard the ship for which the Captain is responsible. 11. The transport of vehicles covered by this ticket shall be undertaken in accordance with the applicable legislation in force and the international agreements entered into by Spain. 12. The exercise of rights relating to this ticket in national coastal routes is subject to the applicable jurisdiction pursuant to the Spanish Civil Procedure Act in force. Where sea transport is undertaken on an international route, travellers are subject to the jurisdiction of the Courts deemed applicable in accordance with the 1974 Treaty of Athens and/or any other instruments amending this Treaty. 13. Passengers, in all cases, will need to collect their boarding pass at our counters at the port ONE HOUR before departure. For vehicle boarding, passengers will need to come to our counters TWO HOURS before departure. Otherwise, the Company reserves its right to freely make use of the seat assigned to the passenger. APPLICABLE LEGISLATION. SUBMISSION TO REGIONAL LAW This contract is ruled by Spanish law, and which will be of application in that not mentioned in this contract in matters of interpretation, validity and undertaking
